Local homes with Chinese drywaWednesday 3 March 2010

Richard Serpe paced behind his desk, a wireless telephone headset affixed to his ear as he discussed courtroom strategies with other attorneys. For months the Norfolk lawyer has worked with scientists and contractors, cutting holes in walls in seven Virginia homes, testing corrosion, and developing estimates for what it will take to remediate homes that contain drywall made in China.

postcard printing

The product emits a noxious gas that, government agencies have found, apparently corrodes electrical appliances, and some homeowners contend that it causes illness.

Serpe represents 86 local residents whose homes contain the drywall. He will present his findings in New Orleans, where the first federal court hearing on drywall is to begin Friday .

Also present will be lawyers representing Knauf Plasterboard Co. Ltd., the subsidiary of a German manufacturer, whose drywall was used widely in Florida, and Mitchell Homes, a builder based in Alabama.

Like Serpe, both groups have done tests on the seven Virginia homes and come up with estimates for how much it will cost to fix the problem.

The stakes are high. The differences in the plans could amount to hundreds of thousands of dollars for homeowners in Hampton Roads and across the country, as the hearing will result in the first federal judicial decision on remediation and help set the standard for federal trials set to begin in March.

Serpe was introduced to Chinese-made drywall in January 2009 when a Chesapeake homeowner called, saying he suspected his home was built with the wallboard after electrical appliances repeatedly failed.

"In one week I went from having never heard of the stuff to nonstop calls about it," Serpe said.

Initially, it looked like the drywall situation would be resolved quickly. The Dragas Cos. , which had identified Chinese-made drywall in homes it had built, offered to relocate homeowners while it spent millions remediating the condos. A large builder in Florida had taken a similar action, but other local builders were resistant.

On May 1, Serpe filed suit in Norfolk federal court on behalf of five clients against Venture Supply Inc., a drywall importer; the manufacturer Taishan Gypsum Co. Ltd.; and the developer of a Norfolk condo complex.

The lawsuit was transferred to a federal court in New Orleans to be tried with hundreds of other cases. After the Chinese manufacturer failed to respond to the suit, U.S. District Judge Eldon Fallon issued a default judgment against Taishan.

Attorneys selected seven homes in Virginia - one in Virginia Beach, two in Newport News and four in Williamsburg - to serve as a cross section of homes affected by the drywall across the country.

Taishan will not take part in the proceedings. Instead, Knauf volunteered to study the seven homes and produce its own estimate for fixing the problem.

The judge is expected to rule on the proposals by March. The decision will be binding only on the seven Virginia homes, but the judge has indicated that outcome will "provide some guidance for similarly situated or affected properties."

"It's going to have huge implications," said Samuel Issacharoff , a law professor at New York University who specializes in complex litigation and class action cases. "Don't underestimate the power that a judge has. The nature of the default judgment is it takes the decision out of the h

Li Na makes quarters double foWednesday 3 March 2010

Li Na makes quarters double for China at Australian Open (updated)

MELBOURNE, Jan. 25 (Xinhua) pandora beads -- China's Li Na followed the footsteps of compatriot Zheng Jie to reach the quarterfinals at the Australian Open on Monday, beating No. 4 seed Caroline Wozniacki of Denmark 6-4, 6-3.

It is the first time two Chinese players have made the last eight of the same Grand Slam.

Zheng became the first Chinese to reach the Australian Open quarterfinals in its 105-year history when she powered past No. 31 seed Alona Bondarenko of Ukraine 7-6 (4), 6-4 on Sunday.

In a match dominated by breaks of serve, Li was down a service break and 4-2 in the first set, but then rattled off the next six games to win the first set.

Li broke Wozniacki's serve in the second set to go up 3-1, then Wozniacki took a medical time-out to have treatment on her lower right thigh. She came back to break Li's serve, but the Chinese player finally held serve at 5-3, sealing it on the second match point after the Dane slapped a forehand long.

Li, the No. 16 seed, had 34 unforced errors compared to Wozniacki's 22. She also nailed 21 winners against three for her Danish opponent.

"Against her, you need to just play on your highest level the whole match through and keep concentrated and keep a lot of balls in play," said Wozniacki, the 2009 U.S. Open finalist.

Li, who skipped the Australian Open 2009 due to a knee injury, will meet American Venus Williams for a place in the semifinals.

"She's a very good player," Williams said of Li, whom she lost to in the Beijing Olympics in 2008.

"Obviously to beat Wozniacki, you have to play very well consistently. I'm sure she did that. Probably I will try to do that in the next round."

Li Chanel Replica Handbags played down the significance of her victory over Venus at the Olympics, saying past glory doesn't account much.

"I don't really remember because it was one-and-a-half years (ago) already," said the 27-year-old.

"It was good experience for me, for my tennis, also. But I just want to forget ... I didn't want always think about the last match. I want to looking forward."

Li's previous best grand slam performances have been quarterfinal appearances at last year's U.S. Open and at Wimbledon in 2006.

Zheng reached the Wimbledon Open semifinals in 2008.

China Focus What price young lWednesday 24 February 2010

China Focus: What price young lives? (2)

"She bought us shoes, socks, sometimes snacks. We don't know where the money is from, " said the boy who has been responsible for feeding pigs from as early as they could remember, without ever tasting their pork.

"If I had money, I would buy my sis some clothes. Hers had been burned to rags," said Yang, in total innocence.

Most of the guardians knew nothing about what the children were up to until the deadly blast, nor did the teachers.

Hezhou city government had allocated one million yuan (some 140,000 dollars) for emergency treatment of the victims immediately after the blast, but given the severity of the injuries, the children will take a long time to recover.

Statistics indicate that some 130 million farmers have left their home villages in 2007 to join the ranks of migrant workers in cities across China and become the main labor force in construction, manufacturing, textile, processing and tertiary sectors.

Meanwhile, over 58 million children are left in their rural homes to the care of grandparents or relatives. Among them, those under 14 account for more than 40 million.

However, the financial crisis triggered by sub-prime mortgage crisis in the United States in 2007 soon spread to the world and left its footprints on Chinese migrant workers whose livelihood rely heavily on foreign orders.

In Dongguan City, Guangdong Province alone, 909 foreign-owned enterprises were closed down in 2007. By mid-2008, revealed the National Development and Reform Commission, 67,000 small and medium- size enterprises (SMEs) had gone bust.

Latest report from the SMEs Research Center of the Chinese Academy of Social Sciences shows that 40 percent of wholesale colthing the country's SMEs have been bankrupt in the sweeping financial crisis. Based on the 2008 figure of 43 million SMEs, the number of failed entities could exceed 17.2 million.

As a result, it is estimated that some 20 million migrant workers affected by the economic downturn were forced to return home in 2008. Although many outsiders take this as a blessing in disguise, at least for those love-thirst children, it soon turned out otherwise.

The All China Women's Federation (ACWF) has sponsored a nationwide research on the impact of returning farmers on their children.

"Due to poor earnings from farming, some 80 percent of returned farmers would go back to cities anyway and the phenomenon of children separated from their parents is here to stay," said Zhao Donghua, team leader of the research.

While much attention has been drawn to the psychological state of these young children, who are left virtually to fend for themselves in the wide open, for many others, the basic rights of survival is at risk.

Eleven days after the explosion in Yanghui Village, a kindergarten bus clashed with a cargo truck in Tianping Township, about three hours' drive from Hezhou, Guangxi, killing six and injuring two, all children left behind by their working parents.

Chen Yali, deputy chief at the public prosecution section of Fuyang City Procuratorate in east China's Anhui Province, has followed 110 juvenile delinquency cases handled at the Procuratorate in 2007. Among them, 73 involve children left behind by migrant workers.

In her views, due to an absence of attentive care, these c

China Focus: Innovation, key for "Made in China" to out of crisis

fake rolex

BEIJING, Sept. 24 (Xinhua) -- China's foreign trade and export enterprises have encountered unprecedented pressure during the global financial crisis -- but analysts say they believe innovation is the way out for the "Made in China" brand.

The Quanzhou Baofeng Shoes Company, one of China's leading producer of slippers, is precisely the type of exporter that should be on its knees. Headquartered in Quanzhou, a coastal city in southeastern Fujian Province, Baofeng used to export 90 percent of its annual output to the United States.

The company's exports fell about 20 percent from a year earlier in 2008 but the situation improved after the company put efforts into developing its domestic market, moving up the value chain and building its own brand, the company's general manager, Zheng Guozhang, said.

"Innovation is the key to a company's success," Zheng said. In this company of 1,000 employees, more than 100 are working on research and development.

Zheng expects exports to start picking up no later than the second half of 2010.

It is a similar story in southern Guangdong Province, the world's largest base of toy production and exports. Customs figures show products of self-owned, independent brands have achieved better and faster growth than those without independent brands.

Guangdong's toy exports from self-owned brands expanded from January's 48 million U.S. dollars to 100 million U.S. dollars in July, up 41.4 percent compared with June.

rolex replica While Baofeng might be surviving rather than thriving, its performance is encouraging, considering wider pain across China's export sector.

Exports, one of the three engines that have fueled China's fast growth in recent times, fell 22.2 percent year on year in the first eight months this year. The other two engines are investment and consumption.

Some export companies had to close or shut down production because of falling orders, which caused millions of job losses.

Analysts believe the global financial crisis and its aftermath have revealed long-existing problems in China's export sector -- lack of independent brands and technology innovation. However, the crisis also offered an opportunity for transformation.

The opportunity is costs for innovation are low, said Lin Jiang, head of the Public Finance and Taxation Department of Lingnan College of the Sun Yat-sen University.

China's export companies are facing stern challenges both at home and abroad and these would persist into the post-crisis period, said Zhang Yansheng, director of the Institute of Foreign Trade of the National Development and Reform Commission, China's top economic planner.

Exporters had to suffer falling orders and increasing protectionism from outside while internally they had to go through painful transformation, Zhang said.

To survive the challenges, domestic enterprises must transform from the traditional labor-intensive and capital-intensive production methods to technology-intensive, and move from imitation to innovation, he said.

"By using today's difficult economic environment as an opportunity to upgrade research and development organizations, focus, practices, and management will help companies not only to cut costs but also to raise productivity and speed up ma

Body supports tailored for womWednesday 31 December 1969

NEW YORK -- Drugstore.com is among the web sites and brick-and-mortar retailers offering Wellgate braces and supports for the female form.

"Women are 41% more likely than men to suffer from arthritis, in addition to many other muscle and joint problems as they age," Megan Barclay, a New York City-based physical therapist, said in the fall. "While women are more likely to be affected than men, braces and supports are not characteristically made to fit the female body. Wellgate changes all that."

Wellgate for Women makes braces that are designed for women's proportions. The products are engineered to be form-fitting and comfortable while providing powerful support, stability and protection for fragile joints.

Arthritis is a name for more than 100 different conditions that affect joints in the musculoskeletal system, and can cause fatigue, tenderness, inflammation and muscle pain. Arthritis can be devastating to active women who stave to get the most out of life.

"Physical therapy and exercise help to alleviate arthritis symptoms, and a brace that fits the contours of the female body helps women to exercise more safely," said Barclay. "Women wouldn't wear ill-fitting men's shoes when they exercise, and they shouldn't wear ill-fitting men's braces."

The muscle/body support devices category overall performed respectably in drug stores last year, advancing 3.4% to $261.8 million, according to Information Resources Inc. If private label products were considered a brand, they would lead the market with a 29% share based on a 3.3% gain in sales to $76.7 million.

The top-selling brand, Futuro from 3M Co., posted a 6.7% increase to Prada Replica Handbags $54.7 million, good for a 21% share.

Another strong player was No. 3 Mueller Sport Care from Mueller Sports Medicine Inc., which was up 51% to $14.8 million.

Body scans forbidden by IslamiWednesday 31 December 1969

Saying that body scanners violate Islamic law, Muslim-American groups are supporting a "fatwa" - a religious ruling - that forbids Muslims from going through the scanners at airports.

postcard printing

The Fiqh Council of North America - a body of Islamic scholars - issued a fatwa this week that says going through the airport scanners would violate Islamic rules on modesty.

"It is a violation of clear Islamic teachings that men or women be seen naked by other men and women," reads the fatwa issued Tuesday. "Islam highly emphasizes haya (modesty) and considers it part of faith. The Quran has commanded the believers, both men and women, to cover their Movado Watch Replica private parts."

The decision could complicate efforts to intensify screening of potential terrorists who are Muslim.

After the Christmas Day bombing attempt in Detroit by a Muslim suspect from Nigeria, some have called for the use of body scanners at airports to find explosives and other dangerous materials carried by terrorists.

Some airports are now in the process of buying and using the body scanners, which show in graphic detail the outlines of a person's body.

But Muslim groups say the scanners go against their religion. One option offered to passengers who don't want to use the scanners would be a pat down by a security guard. The Muslim groups are urging members to undergo those instead.

"We support the Fiqh Council's statement on full-body scanners and believe that the religious and privacy rights of passengers can be respected while maintaining safety and security," said Nihad Awad, national executive director of the Council on American- Islamic Relations.

A Yves Saint Laurent Handags Replica spokesman for the Transportation Safety Administration was not available to immediately comment.
